Lawsuit filed after deadly passenger bus accident

On November 14, 2016, Rafii & Nazarian, LLP filed a lawsuit with the Los Angeles Superior Court, Case No.: BC640573, on behalf of their clients, who were passengers on a tour bus that was returning from a trip to Red Earth Casino in Thermal / Salton Sea Beach, CA.

According to the civil lawsuit, on October 23, 2016, at 5:17 a.m., a tour bus shuttling riders back from a casino collided with a tractor-trailer on I-10 West, leaving at least 13 people dead and many others injured. As stated in the lawsuit, the bus was traveling at a high rate of speed when it struck the back of the big rig.

Authorities hope to recover a data recorder that would reveal how fast the bus was traveling and whether the driver braked before impact. The bus, manufactured in 1996, may not have one on board, officials said.

"This accident is extremely unfortunate," said attorney Daniel Rafii. Mr. Rafii further stated, "We will do our best to put the pieces of this puzzle together to bring closure and justice for our clients."

Federal and local investigators are investigating the cause of the deadly crash. After that crash, Gov. Jerry Brown signed a law that requires buses manufactured after 2020 that carry more than 39 people to be equipped with emergency lighting that would automatically illuminate after a collision, to aid with evacuation.

The law also requires bus drivers to provide instructions to all passengers on how to use safety equipment and emergency exits before departing.

A separate bill signed into law was drafted following a tour bus crash in San Francisco's Union Square that injured 19 people. The law requires the CHP to develop protocols for working with cities and counties to increase the number of tour bus inspections within their jurisdictions.
